Terms and Conditions for Waste Removal Battersea

These Terms and Conditions set out the basis on which Waste Removal Battersea provides waste removal and related services to residential and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation booking or receiving the services.

Services means waste removal, rubbish clearance, collection, loading, transportation, recycling and disposal services provided by Waste Removal Battersea.

Waste means any items, rubbish, materials or goods presented for collection, including household waste, garden waste, bulky items and commercial waste, but excluding Prohibited Waste as defined in these terms.

Prohibited Waste means hazardous, dangerous or restricted items such as asbestos, chemicals, solvents, gas cylinders, clinical or medical waste, explosives, oils, fuels, liquids, pressurised containers or other materials that we are not licensed or insured to handle.

Agreement means the contract between Waste Removal Battersea and the Customer, formed when a booking is confirmed.

2. Scope of Services

Waste Removal Battersea provides waste removal and related services within its operational service area, which includes Battersea and surrounding districts. Services may include one-off waste collections, regular waste collections, bulky item removal, garden waste clearance, and other related services as agreed at the time of booking.

All Services are subject to availability and to these Terms and Conditions. We reserve the right to refuse any job that we believe is unsafe, unlawful, beyond our operational capabilities, or outside our service area.

3. Booking Process

Bookings can be made by telephone, email, online form or other communication methods that we may make available. When placing a booking, you must provide accurate details including your name, contact information, service address, type and approximate quantity of waste, access information, and preferred date and time window.

Any quotation provided before we attend the property is based on the information you supply. This quotation is an estimate only and may be adjusted if, upon arrival, the quantity, type, weight or location of the waste differs from what was originally described, or if additional services are requested.

The Agreement between you and Waste Removal Battersea is formed when we confirm your booking and, where required, you have accepted any revised quotation. Confirmation may be given verbally, by email, message or in writing.

You are responsible for ensuring that someone with the authority to confirm the service and sign any collection documentation is present at the property at the agreed date and time.

4. Access and Service Requirements

You must ensure that our team has safe, timely and reasonable access to the waste at the agreed time. This includes arranging any necessary permissions for access to private roads, gated entrances, shared premises or restricted areas, and ensuring that any parking required to carry out the service is available.

Waste must be presented in a manner that allows our team to load it safely and efficiently. Where possible, loose waste should be bagged or contained. Large or bulky items should be reasonably accessible and free from obstructions. We are not responsible for delay or additional charges arising from access issues, blocked drives, locked gates, restricted parking, or similar difficulties.

If access is not available, or the waste is not ready for collection at the agreed time, we may charge a wasted journey or waiting time fee, or treat the booking as cancelled by you.

5. Waste Type and Prohibited Items

You are responsible for accurately describing the waste to be removed and for ensuring that no Prohibited Waste is included in the collection without prior written agreement. Our standard services do not cover hazardous or specialist waste streams.

If we discover Prohibited Waste in your load, we may refuse to collect it, remove only the non-prohibited items, or terminate the service. You will be responsible for any additional charges, legal liabilities, penalties or costs arising from the inclusion of Prohibited Waste that you failed to declare.

We may at our discretion assist in arranging appropriate specialist removal for certain restricted items, subject to additional charges and separate terms.

6. Pricing and Quotations

Prices for our services are generally based on factors including the volume of waste, type of waste, weight, labour involved, access conditions, loading time, disposal and recycling charges, and any additional services requested.

Any quotation given prior to collection is indicative only and not binding until our team has inspected the waste on site. Once on site, we will confirm the final price before commencing work. If you do not accept the final price, you may cancel the service at that stage; however, we reserve the right to charge a call-out or assessment fee to cover our time and travel costs.

We may adjust our pricing from time to time to reflect changes in disposal fees, recycling costs, labour costs, fuel prices, or other operational factors. The applicable price is the one confirmed to you at the time of booking.

7. Payments and Invoicing

Unless otherwise agreed in writing, payment is due in full at the time of service or immediately upon completion of the collection. We accept payment by cash, debit or credit card, bank transfer or other payment methods that we may make available.

For commercial customers with approved credit accounts, payment terms will be as specified on the invoice. If no specific terms are stated, invoices are payable within 14 days of the invoice date.

We reserve the right to charge interest on overdue amounts at the statutory rate, together with reasonable administration and recovery costs. Failure to pay may result in suspension of services and legal action to recover outstanding sums.

All prices are stated exclusive of VAT unless otherwise indicated. If VAT is applicable, it will be added at the prevailing rate.

8. Cancellations and Amendments

You may cancel or amend your booking by giving us reasonable notice. For standard collections, we request at least 24 hours notice before the scheduled arrival time. For larger jobs, including substantial clearances or commercial work, we may require longer notice as specified at the time of booking.

If you cancel within the required notice period, no cancellation fee will normally apply. If you cancel with less than the required notice, or if our team attends and is unable to carry out the work due to your act or omission, we may charge a cancellation fee or call-out fee to cover our costs.

If you wish to change the date, time or scope of the service, we will use reasonable efforts to accommodate your request, subject to availability and any required price adjustment. We are not liable for any loss you may incur if we are unable to accommodate a requested change.

We may cancel or reschedule your booking due to events beyond our reasonable control, including severe weather, accidents, vehicle breakdowns, staff illness, or legal restrictions. In such cases, we will notify you as soon as reasonably possible and offer an alternative time. We will not be liable for any indirect or consequential loss arising from such cancellations or delays.

9. Customer Obligations

You agree to:

Provide accurate information about the waste and the collection location.

Ensure safe and reasonable access to the waste at the agreed time.

Comply with all applicable laws and regulations relating to waste storage, handling and presentation.

Not include Prohibited Waste in any collection without prior written agreement.

Cooperate with our team and follow any safety instructions provided on site.

10. Our Obligations and Service Standards

We will provide the Services with reasonable care and skill, in a professional and timely manner, and in accordance with applicable waste management regulations and duty of care requirements.

We will take reasonable steps to ensure that collected waste is transported and disposed of or recycled at authorised facilities and in compliance with relevant legislation.

While we will aim to arrive within the agreed time window, timing is not guaranteed and may be affected by traffic, operational issues or circumstances beyond our control. We will keep you informed of any significant delays where reasonably possible.

11. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

Subject to the above, we shall not be liable for any indirect, special or consequential losses, including loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the Services.

Our total aggregate liability to you in respect of any claim arising under or in connection with the Agreement shall be limited to the total amount paid or payable by you for the specific service giving rise to the claim.

You are responsible for securing or moving fragile items, valuables, ornaments or other possessions that may be at risk during the collection. We are not liable for damage to items not intended for removal, unless caused by our negligence and notified to us at the time of service.

We are not responsible for any pre-existing damage at the property or for damage arising from structural defects, hidden hazards, poor access routes or circumstances beyond our reasonable control.

12. Waste Regulations and Environmental Compliance

Waste Removal Battersea operates in accordance with relevant UK waste legislation and regulations. We aim to maximise recycling and responsible disposal of all collected waste and to minimise landfill wherever practical.

We may issue or retain waste transfer notes and other documentation as required by law. You agree to provide any information reasonably required for regulatory compliance, including waste descriptions and any declarations relating to the nature of the waste.

Once waste has been lawfully collected and loaded onto our vehicle, title to the waste passes to us and you will have no further claim over it, subject to regulatory requirements. We reserve the right to make reasonable decisions about the sorting, re-use, recycling and disposal of collected items in line with environmental best practice and legal obligations.

13. Complaints and Disputes

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with details of your concern. We will investigate the matter and aim to resolve complaints promptly and fairly.

Any claim relating to damage, loss or service quality should be reported without undue delay and, in any event, within 7 days of the service date. We may request reasonable evidence, such as photographs or written details, to assess your claim.

If a dispute cannot be resolved amicably, either party may pursue their legal rights in accordance with the governing law and jurisdiction set out below.

14. Data Protection and Privacy

We may collect and process personal information you provide when booking or using our Services, including contact details, service address, and payment information. This data is used for the purposes of providing and managing the Services, handling payments, and complying with legal obligations.

We take reasonable steps to keep your personal information secure and to prevent unauthorised access or disclosure. We do not sell your personal data to third parties. We may share your information with trusted partners and service providers where necessary to deliver the Services or meet regulatory requirements.

15. Changes to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, operational practices, legal requirements or industry standards. The most recent version will apply to all new bookings from the date it is made available.

Where a change materially affects an existing booking, we will notify you and give you an opportunity to cancel or re-confirm your booking on the updated terms.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

You and Waste Removal Battersea agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

17. General Provisions

If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining terms, which will continue in full force and effect.

No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

You may not assign or transfer your rights or obligations under the Agreement without our prior written consent. We may assign or subcontract our rights and obligations at any time, provided that this does not materially reduce the level of service you receive.

These Terms and Conditions, together with the details confirmed in your booking, constitute the entire Agreement between you and Waste Removal Battersea in relation to the Services and supersede any prior understandings, representations or agreements, whether written or oral.
